Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Omoggle Game website, web app, APIs and related services (collectively, the "Service") operated by the Omoggle Game team ("Omoggle", "we", "our" or "us"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & account

The Service is restricted to adults aged 18 years or older. By entering the arena you affirm that you meet this age requirement. We use a session-scoped 18+ acknowledgment gate; this is not a legal ID verification. You are responsible for accurate self-reporting and for any use of the Service from your device.

The Service is intended for personal, non-commercial use. You may not resell, sublicense, white-label, scrape, harvest or systematically extract data from the Service without prior written permission.

2. The arena, PSL scan and ELO

The Service offers timed 1v1 video face-offs ("mog battles"), an on-device facial keypoint scan that produces a private "PSL" score, and a global ELO leaderboard. PSL scores and ELO are entertainment metrics — they have no clinical, medical or social-science meaning. You agree not to rely on them as advice of any kind.

Match outcomes, audience votes and ELO movements are final. We may adjust ELO for accounts that abuse the system (collusion, bots, alt accounts, vote manipulation, etc.). We may refuse, suspend or terminate access at our sole discretion in cases of abuse.

3. Camera, microphone and live video

The Service uses your device camera through your browser's standard permission prompt. Camera frames are processed locally and streamed peer-to-peer to your matched opponent for the duration of a round. By turning on your camera you grant the matched user a temporary ability to view your live feed for the round.

You are solely responsible for what your camera captures. Do not turn on your camera in any context that violates these Terms, our Acceptable Use Policy, or the rights of any third party (including bystanders captured on camera).

4. Acceptable use

You agree to comply with our Acceptable Use Policy. In particular, you may not use the Service to:

We reserve the right to remove content, throttle accounts and ban users who violate these rules — without refund and without notice.

5. Pricing & payments

Most features are free. Optional paid upgrades — currently Omoggle Pro, a one-time payment of $9.90 USD for lifetime upgrade access — are sold through our payment partner Creem, which acts as the merchant of record. Prices shown on the pricing page are exclusive of VAT/sales tax; any applicable tax is calculated and disclosed at checkout.

By completing checkout you authorize Creem to charge the payment method you provided for the total amount displayed. The charge is one-time only — there is no recurring billing for Omoggle Pro. Receipts are emailed to you by Creem.

Pro access is linked to the email used at checkout. Sharing, reselling or transferring your Pro access to another person is prohibited and may result in revocation without refund.

6. Refunds

Within 14 days of purchase, contact [email protected] with your order ID for a no-questions-asked refund of Omoggle Pro. After 14 days, refunds are evaluated case by case. Refunds may be declined for accounts found to be in violation of these Terms or our Acceptable Use Policy. Full details are in our Refund Policy.

7. Privacy

Our handling of personal data is described in the Privacy Policy. In short: facial keypoint analysis runs entirely on-device, camera frames are never uploaded to our servers, and only minimal metadata (match outcomes, ELO, purchase records via Creem) is retained.

8. Intellectual property

The Service, including its design, code, branding, copy, audio and imagery, is owned by Omoggle Game and protected by copyright, trademark and other laws. You retain ownership of content you create or display through your camera; by using the Service you grant us a limited, royalty-free license to transmit and display that content for the purpose of operating the Service. We do not claim any rights to your face or likeness beyond what is necessary to provide the matchmaking and audience-voting functionality.

9. Termination

We may suspend or terminate your access at any time for violation of these Terms, our Acceptable Use Policy, or for legal, operational or security reasons. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, indemnity, limitation of liability, governing law) will survive.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted operation. PSL, ELO, rank and any other metric are for entertainment purposes only. Audience votes are subjective and do not reflect the views of Omoggle Game. We do not guarantee match availability, audience turnout or specific outcomes.

11. Limitation of liability

To the maximum extent permitted by law, Omoggle Game and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, data, business or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for direct damages will not exceed the greater of (a) the amount you paid to us in the 12 months prior to the event giving rise to the claim, or (b) USD $50.

12. Indemnity

You agree to defend, indemnify and hold harmless Omoggle Game, its affiliates, officers and contractors from any claim, demand, loss or expense (including reasonable attorneys' fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect any change. Material changes will be announced on the website. Continued use of the Service after a change constitutes acceptance of the updated Terms.

14. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Omoggle Game operating entity is established, without regard to its conflict of laws rules. Any dispute arising under these Terms will be resolved by the courts of that jurisdiction, except where mandatory consumer-protection law grants you the right to bring the dispute in your country of residence.
